Training and Boxing Class Waiver and Release of Liability This Agreement is entered into between the undersigned participant, hereinafter referred to as the "Client," and A Better You Fitness Inc, a California-based fitness and boxing training service, and its owner, Paul Casey, and Jesus Alvarez, operating as Box N Flow, hereinafter collectively referred to as the "Company." 1. Assumption of Risk: I, the undersigned Client, understand and acknowledge that participating in personal training and boxing classes at A Better You Fitness Inc, a facility owned and operated by Paul Casey, and under the supervision of Jesus Alvarez of Box N Flow, involves inherent risks, including but not limited to the risk of injury. I voluntarily assume all such risks and agree that A Better You Fitness Inc, Paul Casey, Jesus Alvarez, its trainers, employees, and representatives shall not be liable for any injury, illness, or damage to my person, whether caused by the negligence of the Company or otherwise. 2. Medical Clearance: I hereby represent and warrant that I am in good health and have no physical conditions that would prevent my participation in personal training and boxing classes. I acknowledge that it is my responsibility to consult with a physician before commencing any exercise program. 3. Release of Liability: I release, discharge, and hold harmless A Better You Fitness Inc, Paul Casey, Jesus Alvarez, its owners, trainers, employees, and representatives from any and all claims, demands, actions, or causes of action arising out of or in connection with my participation in personal training and boxing classes. 4. Waiver of Liability: I waive any right to assert a claim against A Better You Fitness Inc, Paul Casey, Jesus Alvarez of Box N Flow, for any damages, losses, or expenses arising out of my participation in personal training and boxing classes. 5. Insurance: I understand that A Better You Fitness Inc, Paul Casey, Jesus Alvarez of Box N Flow, does not provide personal or health insurance for participants. I am encouraged to obtain my own insurance coverage for any injuries or illnesses that may occur during training sessions or classes. 6. Photographic Release: I grant A Better You Fitness Inc, Paul Casey, Jesus Alvarez of Box N Flow, the irrevocable right to use my likeness, image, or photograph in any promotional materials, advertising, or other media without compensation. 7. Compliance with Rules: I agree to comply with all rules and instructions provided by A Better You Fitness Inc, Paul Casey, Jesus Alvarez of Box N Flow, including but not limited to safety guidelines, proper use of equipment, and respectful conduct towards trainers and fellow participants. 8. Protection for Training Facility: I acknowledge that the training facility, A Better You Fitness Inc, owned and operated by Paul Casey, shall not be responsible for any loss or damage to personal property or belongings brought to the facility. 9. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of California. 10. Severability: If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. 11. Acknowledgment of Understanding: I have read this waiver and release of liability, fully understand its terms, and voluntarily agree to its terms.
